Terms of Service

These Terms of Service define the rules, responsibilities, and conditions for using Valuera Hosting services.

1. Acceptance of Terms

By accessing, purchasing, or using any services provided by Valuera Hosting, you agree to be bound by these Terms of Service.

If you do not agree with these terms, you must not use our website, products, or hosting services.

2. Services

Valuera Hosting provides hosting-related services, including but not limited to game server hosting, web hosting, infrastructure services, and related digital products.

Service availability, features, performance, and limits may vary depending on the selected plan or product.

3. Accounts and Customer Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity performed through your account.

You agree to provide accurate, current, and complete information when creating an account or placing an order.

  • You must not share your account access with unauthorized third parties.
  • You must notify us immediately if you suspect unauthorized access.
  • You are responsible for keeping your contact and billing information up to date.

4. Acceptable Use Policy

You agree to use Valuera Hosting services only for lawful purposes and in accordance with these terms.

We reserve the right to suspend or terminate services that violate our acceptable use requirements.

  • No illegal content or activity is permitted.
  • No malware, phishing, spam, botnets, or abusive automation is permitted.
  • No attacks, port scanning, exploitation, or unauthorized access attempts are permitted.
  • No activity that disrupts, damages, or overloads our infrastructure is permitted.

5. Payments, Billing and Renewals

All fees must be paid according to the pricing and billing terms shown at the time of purchase.

Services may be suspended or terminated if invoices remain unpaid.

5.1 Renewals

Recurring services renew automatically unless cancelled before the renewal date.

5.2 Failed Payments

If a payment fails, access to the related service may be restricted, suspended, or terminated.

6. Payment Reminder and Debt Collection Process

If an invoice remains unpaid or an automatic payment method fails while a service is active, Valuera Hosting will begin a structured payment reminder process.

Customers are responsible for ensuring that their selected payment method remains valid, active, and sufficiently funded.

Payment reminders are sent to the email address stored in the customer account. Customers are responsible for keeping their contact information up to date.

Each payment reminder may include an additional reminder processing fee of €1.50 where permitted by applicable law and stated on the invoice or reminder.

6.1 Step 1 - First Payment Reminder

The first payment reminder will be sent by email after the payment due date or after an automatic payment method has failed.

A reminder processing fee of €1.50 may be added to the outstanding balance where permitted by applicable law.

6.2 Step 2 - Second Payment Reminder

If the outstanding invoice remains unpaid after the first reminder, a second payment reminder will be sent by email.

An additional reminder processing fee of €1.50 may be added to the outstanding balance where permitted by applicable law.

6.3 Step 3 - Final Payment Reminder

If payment is still not received, a final payment reminder will be sent before further action is taken.

An additional reminder processing fee of €1.50 may be added to the outstanding balance where permitted by applicable law.

The customer must settle the outstanding invoice, including any applicable reminder fees, within the deadline stated in the final reminder.

6.4 Service Deactivation

If the customer does not respond to the three payment reminders and the outstanding balance remains unpaid, Valuera Hosting may deactivate, suspend, or terminate the affected active service without further notice.

Service restoration may require full payment of all outstanding invoices, reminder fees, and any applicable reactivation charges.

6.5 Debt Collection and Legal Enforcement

In serious cases, repeated non-payment, high outstanding balances, chargebacks, fraud attempts, or continued failure to respond may result in the claim being transferred to a debt collection agency or pursued through legal proceedings.

Any additional costs resulting from debt collection, legal enforcement, chargebacks, or third-party recovery services may become the responsibility of the customer where permitted by applicable law.

7. Refunds and Cancellations

Refund eligibility depends on the type of service purchased, the time since purchase, and whether the service has already been delivered or used.

To cancel a service, you must submit the cancellation through the available customer panel or support channel.

  • Setup fees, custom services, and consumed resources may be non-refundable.
  • Chargebacks without prior support contact may result in account suspension.
  • Cancellation does not automatically refund previous payments.

8. Service Availability

We aim to provide stable and reliable services, but we do not guarantee uninterrupted availability at all times.

Maintenance, technical issues, third-party failures, attacks, or force majeure events may affect service availability.

9. Customer Data and Backups

You are responsible for maintaining your own backups unless a specific backup service is included in your plan.

We are not liable for data loss caused by customer actions, software errors, abuse, suspension, termination, or events outside our reasonable control.

10. Suspension and Termination

We may suspend or terminate your services if you violate these Terms of Service, fail to pay invoices, abuse our infrastructure, or create risk for Valuera Hosting or other customers.

Termination may result in loss of access to services and data associated with the affected account.

11. Limitation of Liability

To the maximum extent permitted by law, Valuera Hosting is not liable for indirect, incidental, special, consequential, or punitive damages.

Our total liability for any claim related to the services is limited to the amount paid by you for the affected service during the relevant billing period.

12. Changes to These Terms

We may update these Terms of Service from time to time.

Continued use of our services after changes become effective means that you accept the updated terms.
